Will be officially established the professional title of trademark attorney

According to the Article 6 of the newly revised Trademark Law, an agent may be appointed to handle applications for trademark registration and other procedural matters. However, those who do not have a residence or business place within the territory of the Republic of China should appoint an agent to handle the matter. The agents in the preceding paragraph is limited to those who have domicile in the country and have one of the following qualifications:
1. Professionals who are legally allowed to perform trademark agency business (currently only lawyers and accountants are allowed).
2. Trademark attorney (a new title for those who will perform trademark agency business will then be established).
The above-mentioned trademark attorney must pass the trademark professional competency certification examination organized by specialized trademark academy or have been engaged in trademark examination work for a certain period of time, who apply for registration and complete on-the-job training every year before they can perform trademark agency business. That said, in addition to lawyers and accountants, the recommended path to serve as a trademark attorney in the future will be to participate in the "IP Professionals - Trademark Category" competency certification examinations organized by Taiwan Intellectual Property Training Academy (TIPA) every year, including category A for trademark application and management and category B for trademark rights protection and use. Those who have obtained the said competency certifications in the trademark category can be considered to be able to skillfully handle trademark applications, examinations, litigation and other procedures with a deeper understanding of trademark protection. They will gain a higher degree of trust in this professionalism.
